Is there any source to support this view? I was also thinking in that way but was not able to find anywhere because they mentioned that only the research institutes from university and government are non-profit organizations? Please help me to clarify, I am not selected in H1b this time but planning to apply for city and county jobs? Just want to make sure before applying because I am working in a really good company now.

please do some research.  i am sure all public jobs are exempted from H1b quota.  if they are willing to sponsor your H1b, lawyer might be a good help.

Timer,

I ran into this same question 3 months ago. I was hired by the state government in engineering position, so i was assuming that my H1B is exampt from the CAP. But unfortunately it is not in exemption. When i  talked to the attorney who did my processing, she told me that  (atleast  in my case)  state Department  jobs  does not fall in the exemption. She told me that it does not fall in non-profit category. Therefore my processing had to go through the quota system. Please be clear about this. talk to the government attorney who should be filing your H1B.

Timer, don't worry. The city, state or county will not hire you as a CIvil engineer unless you have a green card or US citizenship. I dont thibk that they will sponsor H1B bcz foe these posts there is always competition of US citizens or Green card holders.
