My priority date recently became current on the October VB. I am planning to apply I-485 based on EB3 ROW with I-140 approved and valid TPS status. I do have a pending asylum case where they sent me a Notice to Appear I-862 (Removal proceedings) back in 2011. Would anyone know if i am eligible to file I-485 with USCIS? I have been researching a lot and it looks like my case might be denied if i applied in USCIS and i need to apply I-485 in an Immigration Court. The current lawyer i am working with don't have the expertise on such cases.

Any information regarding such cases and your feedback would be highly appreciated.
